1. General Terms and Conditions

The purpose of these General Terms and Conditions of the online store Odeja® is to clearly define the rights and obligations of users of the online store Odeja® (hereinafter: online store) when using the online store, ordering, purchasing and selling goods and services available, as well as the business relationship between Odeja d.o.o. and the online store user.

In accordance with the provisions of the law regulating the rights of consumers in offering, selling, and other forms of marketing of goods and services by companies, a consumer is a natural person who acquires or uses goods and services for purposes outside of their professional or gainful activity (hereinafter: consumer or customer).

The Terms and Conditions cover the operation of the online store, user/customer rights, and the business relationship between Odeja d.o.o. and the customer. These Terms and Conditions govern the sale of goods available in the online store.

A purchase made through the online store is considered a purchase made in accordance with the applicable regulations in the Republic of Slovenia. Applicable legislation directly governs mutual legal relationships, regardless of the provisions of these Terms and Conditions, even if these Terms and Conditions are in conflict with the applicable legislation.

Delivery of goods purchased through the online store is provided by Odeja d.o.o. using its own resources and/or contractual partners in the territory of the Republic of Slovenia.

Before completing the purchase or placing an order, the customer must confirm that they have read and agreed to these Terms and Conditions, otherwise, the order cannot be placed.

These Terms and Conditions can be amended at any time with new provisions; therefore, the customer is advised to read them before any purchase and to print them or save them on their own suitable data medium. Each version of the Terms and Conditions is dated. The customer is bound by the Terms and Conditions applicable at the time of placing the order.

Due to the nature of business via the World Wide Web, the offer in the online store is updated and changes frequently and quickly. Odeja d.o.o. strives to provide clear and comprehensive information to present the basic features of the sales goods, which are stated on the packaging, so Odeja d.o.o. is not responsible for any errors in information or misprints.

All images in the online store and catalogs are symbolic; furthermore, Odeja d.o.o. strives to provide adequate images of all merchandise for sale on its website. Any aesthetic differences between the image and the actual goods do not affect the specification of the goods themselves.

 

2. Registration and login of the Odeja.si online store user

Registration means only the first entry into the database, where the user enters the required data and gives their consent to the presented Terms and Conditions and confirms that they have read them. This creates a user account (hereinafter: user account), and the user thereby becomes a registered user (hereinafter: registered user).

Login means that all the necessary data has already been entered into the database and that the user's email address has already been confirmed in the database (activated). As part of the login, it is only necessary to enter the email address and password for any subsequent access, and the user can change the password later if desired.

Creating a user account is not required for placing an order and making a purchase in the online store. Users who have not registered or logged in (hereinafter: guests) can make purchases in the online store without a user account as guests. For the purposes of placing an order and making a purchase via the online store, an unregistered user or guest must submit all data as defined in these Terms and Conditions.

The user can create the user account during the registration process by entering the basic data required. By checking the appropriate box during registration, the user confirms that they have carefully read the applicable General Terms and Conditions, agree with them and fully accept them, and by accepting the Terms and Conditions, they confirm that they are at least 15 years of age and meet the other conditions for making an online purchase, as defined by these Terms and Conditions.

If at any time later the user wants to change their email address, they can send the request to eprodaja@odeja.si. The change of email address will be carried out on the same or the next workday, and the user will be informed about this via email.

The user can register the user account during the purchase process in the online store.

Required data is necessary for subsequent login procedures and communication in transactions with the registered user and for other types of data processing in accordance with the purpose and legal basis; required data is marked with a star or message that the field is required. In the event that the user does not wish to submit any required information in the use account registration process, the user will not be able to create the user account and will be able to make a purchase only as a guest.

The user can cancel their user account at any time by writing to Odeja d.o.o., Kidričeva 80, 4220 Škofja Loka or by email to eprodaja@odeja.si, with the subject "User account cancellation". After the final confirmation of the cancellation of the user account, the user account will be deactivated. It is not possible to cancel the cancellation of a user account; however, in accordance with these Terms and Conditions, the user can create or register a new user account. The user is responsible for accessing their user account and must ensure that user data and passwords are adequately protected. The user is responsible for the accuracy and correctness of all provided data and is liable for damage caused by inaccurate or untrue data.

Access to information (summary)

The provider undertakes to always provide the customer with the following information:

  1. company identity (name, headquarters, register number);
  2. contact information that allows the user to communicate quickly and efficiently (telephone, email);
  3. essential characteristics of goods or services (including after-sales services and warranties);
  4. availability of items (every item or service offered on the website should be available within a reasonable time);
  5. terms of delivery of items or performance of service (method, place, and deadline of delivery);
  6. all prices must be clearly and unambiguously specified, and it must be clearly shown whether they already include taxes and transportation costs;
  7. method of payment and delivery;
  8. validity of the offer;
  9. the period during which it is still possible to withdraw from the contract and the conditions for withdrawing from the contract, including any associated costs for the customer if they withdraw from the contract;
  10. an explanation of the complaint procedure, including all contact persons or customer service details.

 

3. Prices on the online store Odeja. si

All prices in the online store are in euros and include value-added tax unless explicitly stated otherwise. The prices do not include delivery or postal costs. These are listed when calculating the value of the order before the electronic confirmation of the order in the "Delivery" section.

Prices in the online store may be changed based on automated decision-making, which includes, but is not limited to, the entry of a special offer code.

Online prices are only valid for purchases in the online store. Online and special offer online prices in the online store may differ from regular and special offer retail prices in the retail network (physical stores). Odeja d.o.o. reserves the right to change prices without prior notice on a daily or hourly basis.

Types of prices:

  • Online prices are regular prices of specific goods and services as published in the online store.
  • Special offer online prices are prices that apply to all customers in the online store during a special offer, if the price is publicly defined or if the customer has a discount code based on which the special offer online price is displayed.

The prices are valid at the time the order is placed, or the prices that were valid at the time the placed order was received by the online store's information system. A discount on a specific item or service and a discount code is not cumulative in principle unless this is explicitly stated in exceptional cases. The contract of sale between Odeja d.o.o. and the customer is concluded when Odeja d.o.o. confirms the order or the customer receives an "Order Confirmation" email. From this moment on, all prices and other terms and conditions are fixed and are binding for Odeja d.o.o. and the customer.

Before confirming the order, every customer must familiarise themselves with these General Terms and Conditions; if they agree to these general terms and conditions during the purchase process and confirm the order, it is considered that they have read and familiarised themselves with these Terms and Conditions.

 

4. Purchase process on the online store Odeja.si

When the customer selects a product or product and submits an order by clicking the "Submit order" button, the online store automatically creates and sends an email with order details (order number, customer information, products, prices, quantities, etc.). If the customer pays cash on delivery or via PayPal, the provider will send the purchased products to them within a maximum of 5 (five) workdays after the order is confirmed by the provider. If the customer makes the payment based on a proforma invoice, the provider will send the purchased products to them within a maximum of 5 (five) workdays after the provider receives payment on their transaction account.

If the customer decides to cancel the order before receiving the goods, they must immediately notify the provider by telephone at 04 51 30 155 (between 8:00 am and 3:00 pm every day except Saturdays, Sundays, and holidays) or by email at eprodaja@odeja.si. If the order has already been shipped, the customer rejects the shipment on delivery by the delivery service. In the case of personal pick-up (when the goods are already ready for pick-up), the customer also communicates their decision to cancel the order via the above phone number or email address.


Ordering in the online store is possible via the Internet 24 hours a day, seven days a week. You can choose and order goods from the list of goods on the website of Odeja d.o.o. All goods listed on these pages are available until stocks are sold out or the sale of specific goods is discontinued.

The purchase process is simple and can be done as a registered user using a user account or without a user account as a guest by entering the required personal information before placing each individual order.

The user account allows the user to review all submitted orders and to submit an online order faster by pre-filling the fields with personal data and providing other functionalities, which only apply if the user has data saved in a Google account.

Submitting an order as a guest allows submission of an online order without a user account, i.e. without registration and login with a user account.

An order can be submitted in two simple steps, as described below:

 

a.Cart

On this screen, you can view the items that you have previously added to the cart. You can change the desired quantity for each item or remove the item from the cart.

You can enter a "discount code" in the Cart.

If you select CONTINUE TO PAYMENT, the website will redirect you to the last simple step for placing the order: delivery and payment method details.

 

b.Purchase completion

In this simple final step, the customer enters delivery and payment method details and confirms the purchase by clicking "Submit order". To place an order, you must agree to the Privacy Policy and the General Terms and Conditions of the Odeja.si online store.

 

DELIVERY INFORMATION

In this step, you will be able to make a purchase as a guest or as a registered user. You will also be able to register as a new user.

If you have not yet registered and logged in to the online store, you will have to choose how to continue before completing the purchase – either by logging in with a user account (or registering a new user) or by purchasing as a guest.

When registering as a new user, you will have to agree to the Privacy Policy and the Terms and Conditions.

When entering your information, you will have the option to use a different delivery address than the address specified during registration.

 

DELIVERY

The provider must deliver the goods or services within the promised time. When placing the order, the customer can specify a delivery address that is binding for the provider. Upon delivery, the provider must provide additional information regarding the right of withdrawal, especially the conditions and methods for exercising this right. The provider must provide all necessary information regarding who the customer can contact in case of complaint and information regarding warranties and repair or other services after the conclusion of the contract.

If the customer (recipient) is not at the address at the time of delivery, it is possible to pick up the package at the post office (where the package was addressed) within 15 days. If the customer (recipient) does not pick up the package within 15 days, it will be returned to the provider.

The contractual partner for the delivery of parcels is the Post of Slovenia, but the provider reserves the right to choose another delivery service if this will facilitate a more efficient fulfillment of the order.

 

Delivery costs

Slovenia

  • When purchasing products worth up to EUR 19.99, the delivery cost is EUR 3.
  • When purchasing products worth EUR 20 or more, the delivery is free of charge.

Croatia

  • When purchasing products worth up to EUR 149.99, the delivery cost is EUR 7.
  • When purchasing products worth EUR 150 or more, the delivery is free of charge.

EU countries and third countries

  • Delivery costs vary by country and will be listed when you select the country before paying for the purchase.
  • Delivery costs are calculated according to the current price list of the Post of Slovenia.

 

PAYMENT

  1. Cash payment on delivery
  2. Bank transfer to the provider's account according to the proforma invoice or offer
  3. Debit and credit cards through the SIY Payment service
  4. Using PayPal

At the completion of the order, by selecting the check box, you confirm that you have read, fully understood, and agreed to the Terms and Conditions, that you are over 18 years of age, and that you have not been deprived of legal capacity.

By clicking the "Submit order" button, you complete the purchase process.

After completing the purchase on the website, you will be redirected to the thank you page, where there will be information about the confirmed order, and you will also receive an email with all information about your order and delivery.

The contract of sale between Odeja d.o.o. and the customer is concluded when Odeja d.o.o. confirms the order (the customer receives an "Order Confirmation" email). From this moment on, all prices and other terms and conditions are fixed and are binding for Odeja d.o.o. and the customer. The contract of sale is concluded in Slovenian. The customer is informed about the status of the order via email. Order statuses are processed, prepared, and completed. The customer will be informed about all status changes via email.

 

5. Offer and validity of the offer

When making a purchase, the prices apply at the moment of order confirmation. All prices include VAT calculated on the basis of Articles 48 and 49 of the Value Added Tax Act and not disclosed on the basis of the Article 50(c) of the Value Added Tax Act. Prices on the online store can be changed without prior notification. Images can for information purposes only and do not fully reflect the actual situation.


The offer in the online store includes various groups of goods and services, displayed as categories that are visible on every screen.

Odeja d.o.o. reserves the right to reject the order if the goods are no longer in stock or if the customer orders goods or service in quantities that are not normal, about which we will notify you as soon as possible.

Odeja d.o.o. also reserves the right to refuse delivery of goods to the customer if they have outstanding past orders or are in a legal dispute with Odeja d.o.o. regarding a placed order or purchase via the website, in the event of past abuse of the system or past abuse of the right to return goods, and in other cases defined in these Terms and Conditions. Submitted orders will be processed during business hours from Monday to Friday in the order they were received or according to the scheduled times for collecting the goods.

 

6. Payment

You can choose between the following methods of payment: cash on delivery, payment of proforma invoice, credit card, or payment via PayPal.

When paying the proforma invoice received by email, the deadline for payment of the proforma invoice will be specified. After this deadline, Odeja d.o.o. does not guarantee a reservation for ordered products. After receiving the payment according to the offer or proforma invoice, the order is submitted to processing.

In the event of a purchase of goods, the purchase price must be settled before delivery.

After placing the order, it is not possible to change the content of the order or of the final amount of the order, which applies to all payment methods.

For orders paid by card, the price will be charged on the day you place the order. The online store provides all necessary technological and organisational solutions for complete purchase security. The transfer of sensitive personal and transaction data on the website is carried out securely using the SSL (Secure Sockets Layer) protocol. The data is encrypted and transmitted to the hosting server in a protected form. The system thus prevents anyone from intercepting your personal and transaction data that you send to the online store.

The safety of the purchase is also ensured by complying with all valid legal obligations and recommendations of the Slovenian and international consumer association.

Check with your payment card provider whether the online payment feature is enabled with the card you want to use.

 

7. Issuance of an invoice

Odeja d.o.o. must issue an invoice for the supply of goods or services, and hand it over to the customer.

After making an online purchase, the customer will first receive an order confirmation by email, and after the goods have been shipped, an invoice in physical form in the delivered package.

 

8. Discount code, free gift, and prize games – valid for consumers

A discount code can be used on the online store.

A discount code or a special sale code provides various benefits when purchasing via the online store. You can find an active code on the front page of the advertising message, in the email message of the online store, or in other media. A code provides various benefits, from various gifts to discounts. Any code is always time-limited and must be used within a limited period; otherwise, it becomes invalid. If a customer uses a discount code or later cancels the order with the used code of their own free will, they are no longer entitled to a new benefit from this code. Discount codes are not cumulative and do not apply to products on sale, unless otherwise stated.

Discount codes provide various benefits when purchasing and are time-limited.

A discount code cannot be used:

  • for purchases of goods and services on special sales;
  • in special cases defined by Odeja d.o.o. based on the type of code.

How to use a discount code:

  • Select the goods you want to purchase and add them to the cart.
  • Under the first step (Cart), there is a field for entering a discount code; enter your code and click on the "Continue to payment" button.
  • If the entered discount code is correct, the discount is automatically included.
  • The discount code reduces the total value of the cart or the value of an individual product or line of products, or similar, which will be listed on each specific code.
  • A code can also reduce delivery costs. In special cases, an individual code can be either exclusive or not, depending on the type of code.

A discount code can be used by registered users and guests of the online store.

Odeja d.o.o. will organize prize draws, adopting special terms and conditions for each prize draw. The provider organizes several prize draws in its stores, on its website, or on its Facebook page, which is always subject to the general provisions published at the start of the prize draw. Each prize draw is time-limited, with the start and end date and time clearly listed and posted for customers several times through various announcements. Only natural persons with permanent residence in Slovenia who agree to the General Terms and Conditions of the prize draw can participate in the prize draw and receive a prize. Employees of Odeja d.o.o. may not participate in the prize draw. Prize draw participants allow the provider to manage, maintain, combine, and process the personal data filing system of participants and registered users in accordance with the Personal Data Protection Act (Official Gazette of the Republic of Slovenia, no. 86/04 and 67/07). The provider ensures the protection of personal data in accordance with the law. The provider may process the collected personal data for the purposes of informing about the prize draw, sampling, surveying, and statistical data processing, for determining the use of services, adjusting the offer and segmentation, for market research, informing about the offer, innovations, benefits, and for other marketing purposes. The provider undertakes not to transfer the data to third parties. Furthermore, the winner allows the publication of their name, surname, and photo on the provider's website and Facebook page. A prize cannot be exchanged for cash or another prize.

Odeja d.o.o. may also award free gifts, reserving the right to choose the gift itself. Gift exchanges are not possible.

 

9. Customer's right to withdraw from the contract

Withdrawal from the contract – applies only to consumers


As a consumer (the option of withdrawing from the contract defined below in accordance with the current Consumer Protection Act is only available to customers who are considered consumers), you have the right to notify us within 15 days that you are withdrawing from the contract without having to provide a reason for your decision. To exercise the right to withdraw from the contract, the consumer must notify Odeja d.o.o. with an unequivocal statement about the decision to withdraw from the contract.

The withdrawal period for the purchase of goods begins on the day when:

  • the consumer or a third party other than the carrier named by the consumer acquires possession of the goods;
  • the consumer or a third party other than the carrier named by the consumer acquires possession of the last item of goods if the subject of the contract is several items of goods ordered by the consumer in one order;
  • the consumer or a third party other than the carrier named by the consumer acquires possession of the last shipment or item of goods, if the delivery of goods consists of several shipments or pieces.

The consumer is deemed to have submitted the withdrawal statement on time if, in the case of the purchase of goods, they send it within 15 (fifteen) days of accepting the goods, which is specified for withdrawal from the contract.

Withdrawal from the contract can be communicated by submitting a correctly completed form for withdrawal from the contract, which is attached to these Terms and Conditions, as well as by another unequivocal statement of withdrawal from the contract, with an attached copy of the documents that were enclosed with the delivery of goods, proving the identity of the goods and the buyer, to the email address eprodaja@odeja.si. Withdrawal from the contract can be sent to the email address: eprodaja@odeja.si.

The consumer bears the burden of proof in regard to exercising the right of withdrawal under this article.

The cost of returning the goods is borne by the consumer.

The goods must be returned to Odeja d.o.o. within 14 days of the notification of withdrawal from the contract at the latest. The consumer is deemed to have returned the goods on time if they sent them to the address of Odeja d.o.o. before the expiry of the 14-day period for returning the goods.

The consumer is liable for any decrease in the value of goods, if the reduction of value is caused by actions not required for determining the nature, properties, and performance of goods (for example: opening a product wrapped in foil, e.g. bedding that is packed in foil; if the product is tested with the foil removed or without the foil, a return is no longer possible, as it is not necessary to open the foil to determine the nature, properties, and performance of the goods). The consumer's liability for the decreased value of the goods may amount to the value of the full regular retail price of the goods on the day of purchase of the goods, which is determined on a case-by-case basis. Because of the liability for the decreased value of the goods, we recommend that the consumer return the goods for which they are withdrawing from the contract undamaged, unused, in the same quantity, and in the original, unopened packaging, to prevent damage during transportation. Odeja d.o.o. shall call upon the consumer to pay any determined reduced value of the goods.

The goods can be returned by post to Odeja d.o.o., Kidričeva 80, 4220 Škofja Loka. Return can also be made in person at the same address, every weekday from 9:00 am to 7:00 pm.

Unless Odeja d.o.o. and the customer have agreed otherwise, the consumer does not have the right to withdraw from the contract within 14 days, as stipulated in this article of the General Terms and Conditions, for the following contracts:

  • for goods and services, the price of which depends on market fluctuations that are beyond the influence of Odeja d.o.o. and which may occur within the withdrawal period;
  • for goods that are manufactured according to the exact instructions of the consumer and adapted to their personal needs (for example a custom order that is not a standard size);
  • for the delivery of sealed goods that are not suitable for return due to health protection or hygiene reasons, if the consumer has opened the seal after delivery or if there is reasonable suspicion that the seal has been opened (for example: opening a product wrapped in foil, e.g. a product for asthmatics, which is packed in foil; if the product is tested with the foil removed or without the foil, a return is no longer possible).

If the consumer withdraws from the contract in accordance with this article of these General Terms and Conditions, Odeja d.o.o. shall refund all received payments without undue delay, no later than 14 days from the date of receipt of the written notice of withdrawal from the contract. Odeja d.o.o. shall make the refund using the same method of payment as was used in the original transaction, unless expressly agreed otherwise in writing.

Odeja d.o.o. withholds the refund of the received payments until the returned goods are accepted or until the consumer provides proof that they sent the goods back in the same condition as when they received them.

The consumer is liable for any decrease in the value of goods, if the reduction of value is caused by actions not required for determining the nature, properties, and performance of goods (for example: several days of use of the goods, washing the goods with a washing machine, opening the protective foil on the product, etc.).

Odeja d.o.o. can refuse the customer's order or, despite confirmation of the order, withdraw from the distance contract, if it is established that the customer is abusing the right to withdraw from the contract.

 

10. Warranty claims

 

a) Warranty claims on delivery

In the event of visible damage to the packaging or the goods, the customer's claim must be submitted upon receipt of the goods, specifically to the delivery service, Post of Slovenia. The customer is not obliged to accept such goods and may refuse the shipment.

If the package is physically damaged, has missing contents or shows signs of being opened, or if the goods in the package are damaged, but the customer has collected such a package anyway, the customer must submit a claim to the delivery service, specifically within 7 days from of the date of receipt of the goods, and the customer must send the notification about the damaged shipment by email to eprodaja@odeja.si. The customer should provide photos of the damage (goods or packaging), information about the delivery person, and a description of the damage when submitting the claim. In any case, we recommend that you take photos of the goods from several angles upon receipt, especially if you suspect from the exterior that the goods may be damaged inside. In such cases, we also recommend that you keep the original transport packaging just in case, at least until you determine that the product does not have any faults. In this way, you can significantly affect how fast the warranty claim is resolved.

Odeja d.o.o. undertakes to resolve the warranty claim as soon as possible, but is not responsible for damage during delivery if it is not responsible for delivery. The customer is obliged to check the package and its contents in the presence of the delivery person before accepting it. Odeja d.o.o. is not obliged to accept buy-back shipments or shipments that do not comply with these General Terms and Conditions.

 

b) Warranty claims for material defects

When is a defect a material defect? A defect is a material defect under the following conditions:

  • If the product does not have the features necessary for its normal use or transaction.
  • If the product does not have the features necessary for special use for which the buyer has made the purchase, but of which the seller is aware or should be aware.
  • If the product does not have the features and characteristics that were explicitly or implicitly agreed upon or prescribed.
  • If the seller delivered a product that does not match the sample or model unless the sample or model was shown for information purposes only.

How is the suitability of the product checked?

  • It is checked against another, faultless product of the same type, and against the manufacturer's statements or indications on the product itself.

IMPORTANT:

  • The consumer has two years from the day the item was delivered to claim their right due to a material defect.
  • The consumer can exercise their right due to a material defect if they notify the seller within two months of discovering the defect.
  • When reporting the defect, the consumer must describe the defect in detail and allow the seller to examine the product.
  • The consumer can notify the seller of the defect personally, for which the seller must issue a receipt, or send it to the store where the item was purchased, or to the representative of the seller with whom they concluded the contract.
  • The seller is not liable for material defects that become evident after two years of product delivery.
  • If the defect is not disputed, the seller must comply with the consumer's request as soon as possible, but no later than within eight days.
  • If the defect is disputed, the seller must respond to the consumer's request in writing no later than eight days after receiving it.

 

11. Delivery deadline, delivery, and acceptance of goods

DELIVERY DEADLINE

If you decided to pay cash on delivery, use a debit or credit card via the NestPay service or via the PayPal service:

  • For products in stock, the ordered goods are shipped to the customer 1–5 workdays after confirmation of your order.
  • For products not in stock, we inform the customer about delivery options via email or phone.

If you decided to pay by proforma invoice:

  • For products in stock, the ordered goods are shipped to the customer 1–5 workdays after receiving payment to our bank account.
  • For products not in stock, we inform the customer about delivery options via email or phone.

 

DELIVERY

The provider must deliver the goods or services within the promised time. When placing the order, the customer can specify a delivery address that is binding for the provider. Upon delivery, the provider must provide additional information regarding the right of withdrawal, especially the conditions and methods for exercising this right. The provider must provide all necessary information regarding who the customer can contact in case of complaint and information regarding warranties and repair or other services after the conclusion of the contract.

If the customer (recipient) is not at the address at the time of delivery, it is possible to pick up the package at the post office (where the package was addressed) within 15 days. If the customer (recipient) does not pick up the package within 15 days, it will be returned to the provider.

The contractual partner for the delivery of parcels is the Post of Slovenia, but the provider reserves the right to choose another delivery service if this will facilitate a more efficient fulfillment of the order.

Odeja d.o.o. is entitled to an extension of the delivery deadline:

  • in the event of a change of the laws, regulations, and other rules that it must adhere to when fulfilling the order;
  • due to a change in the scope, form, or technical implementation of the subject of the order;
  • due to acts or omissions on the part of the customer.

Odeja d.o.o. is not liable for any delay in delivery caused by force majeure or the occurrence of other unforeseeable obstacles that do not arise on its side, but are of such a nature that they have a significant impact on the fulfilment of obligations (government measures related to the epidemic of certain viruses, war or civil unrest, strikes, stoppage of work in industry, failed deliveries, fires, thunderstorms, floods or storms, breakdowns, wilful damage, theft or due to other cases of force majeure, etc.). Odeja d.o.o. has the right to extend the delivery deadline for the duration of such obstacle or events. Odeja d.o.o. must notify the customer immediately regarding the occurrence of such an obstacle.

In the event that the delivery date is postponed for reasons on the part of the customer, the customer is obliged to reimburse Odeja d.o.o. for actually incurred storage costs and any other costs (e.g. repeat delivery, storage, insurance, labour costs, etc.).

Odeja d.o.o. undertakes to deliver the products in the shortest time possible and within the delivery deadline, with deliveries made throughout the entire territory of the Republic of Slovenia.

Generally, deliveries are made in the morning on a workday, or by 4:00 pm at the latest, or according to the schedule of the Post of Slovenia delivery service, which performs the delivery.

 

12. Archiving contracts

The contract concluded by the provider and the customer is permanently stored by the company Odeja d.o.o., Kidričeva 80, 4220 Škofja Loka, Slovenia, which manages the online store.

The provider's advertising emails must contain the following elements:

  • They must be clearly and unambiguously marked as advertising messages.
  • The sender must be clearly stated.
  • Various sales, promotions, and other marketing techniques must be labeled as such. Furthermore, the terms and conditions for participation must be clearly defined.
  • The user's or customer's wish not to receive advertising messages must be respected.

 

13. Complaints and dispute resolution

The provider complies with applicable legislation on consumer protection. The provider must set up an effective complaint-handling system and designate a person whom the user can contact by phone or email in case of problems. The procedure for submitting complaints must be available on the website, easy to use, and confidential. Within five (5) workdays, the provider must confirm the receipt of the complaint, notify the user or customer of the time required for processing, and keep the user or customer informed of the procedure. The provider is aware that an essential characteristic of a consumer dispute, at least as far as judicial resolution is concerned, is the disproportion between the economic value of the claim and the costs incurred in resolving the dispute. This is also the consumer's main obstacle for initiating a dispute before a court. Therefore, the provider strives to the best of its abilities to resolve any potential disputes amicably.

In accordance with the law, Odeja d.o.o. does not have a chosen provider for out-of-court settlement of consumer disputes in charge of resolving consumer disputes that the consumer may initiate in accordance with the Out-of-Court Settlement of Consumer Disputes Act (ZIsRPS). As stipulated by the law, Odeja d.o.o. publishes an electronic link to the Online Dispute Resolution Platform (ODR).

The above arrangement is based on the Out-of-Court Settlement of Consumer Disputes Act, Regulation (EU) No 524/2013 of the European Parliament and of the Council on online dispute resolution for consumer disputes and amending Regulation (EC) No 2016/2004 and Directive 2009/22/EC.

 

14. Personal data protection and privacy

At Odeja d.o.o., we value your privacy, so we always protect your personal data.

Odeja d.o.o., Kidričeva 80, 4220 Škofja Loka, Slovenia, which manages the online store on the website www.odeja.si, ensures the protection of users' personal data by acting in accordance with the regulation and legislation (basis: Personal Data Protection Act – ZVOP-1, Official Gazette of the Republic of Slovenia, no. 94/07, and General Data Protection Regulation – GDPR, effective date 25 May 2018).

For the purposes of online store operation, at www.odeja.si, Odeja d.o.o. collects the following user information: name and surname, address and place of residence, delivery address for goods ordered, email address (username), password in encrypted form, and other data entered by the user upon online store registration or generated during communication between the client and the provider.

The provider shall use personal data in accordance with the guidelines of the EU GDPR, for purposes of order fulfillment and other communication required regarding the order.

In no event shall user data be disclosed to any unauthorized persons.

The provider is not liable for the accuracy of data listed by the user upon registration in the online store. The user also bears responsibility for protection their personal data, specifically by ensuring the security of their username and password and with appropriate software (antivirus) protection of their computer.

The provider stores personal data for an unlimited period or until the user unsubscribes. As the owner of personal data, the user is entitled to access, transcribe, copy, amend, correct, block, or request deletion of their personal data from the provider’s database. The user can withdraw their consent at any time by sending a written request by email to eprodaja@odeja.si.

All submitted data is protected against any third party access, allowing users to conduct their business with Odeja d.o.o. without worries or interruptions. The online store provides all necessary technological and organizational solutions for complete purchase security.

The transfer of sensitive personal and transaction data on the website is carried out securely using the SSL (Secure Sockets Layer) protocol. The data is encrypted and transmitted to the hosting server in a protected form. The system thus prevents anyone from intercepting your personal and transaction data that you send to the online store.

The NestPay system ensures secure authorizations and transactions with payment cards, as well as the intermediary service. Card authorizations are performed in real-time with immediate verification of data in the banking system.

The safety of the purchase is also ensured by complying with all applicable legal obligations and recommendations of the Slovenian and international consumer associations.

 

15. Waiver of liability

The content published on the online store is not allowed to be used or reproduced.

Odeja d.o.o. will strive to provide the most up-to-date and accurate content on the online store, but does not assume any responsibility that they are up-to-date and/or accurate, nor is it responsible for the occasional failure of the website.

The users use all published content at their own responsibility.

Odeja d.o.o. or any other legal or natural person who participated in the development and creation of the online store is not responsible for any damage that would result from access to use or inability to use the information on the web pages of the online store, or for any errors or deficiencies in their content.

To display certain functionalities on the online store, independent external services, and applications are used. Use of these services is subject to the terms and conditions of the external service as determined by the owner of the service or application.

Published photos and videos are symbolic and do not guarantee product features.

Odeja d.o.o. is not responsible for the information in the reviews and does not accept any liability arising from the information in the reviews.

The user is responsible for all activities carried out using their user account or email.

In the event of any unauthorized use or reasonable suspicion that such access has occurred, Odeja d.o.o. must be notified immediately. Odeja d.o.o. is not liable for damage that the user would suffer due to unauthorized use of the user account or password with which the user registered or due to unauthorized use of the user's email.

The user undertakes to use the online store in accordance with the Terms and Conditions, to ensure the secrecy of passwords, and to follow the rules and notices published on the website www.odeja.si.

Odeja d.o.o. shall not be liable for any potential errors and damage caused by submitting incorrect data and/or other activities on the side of the user, e.g. on registration or log in to the online store.

Odeja d.o.o. reserves the right to change, add or remove content published on the online store at any time without prior warning. All users use the published content at their own responsibility and must ensure appropriate protection of data on their own smartphones or other such devices.

 

16. Final Provisions

Odeja d.o.o. complies with applicable legislation on consumer protection. Odeja d.o.o. strives to the best of its abilities to fulfill its duty to implement an effective system for complaint management, and to appoint a person that can be contacted by the customer by telephone or email in the event of problems. The customer can submit a complaint via email to eprodaja@odeja.si. The complaint handling procedure is confidential.

If such a resolution cannot be reached, a dispute shall be resolved before the competent court.
